CONDITIONS OF PARTICIPATION "EASTER SWEEPSTAKE 2024"

The Organiser has the right to change a sweepstake period at any time and without prior notice or to terminate a sweepstake without notice, e.g. if the functionality of the Organiser’s systems should be impaired for technical or other reasons independent of the Organiser or if the suspicion should arise that a participant is trying to influence the results of the sweepstake.

Participation via automated processes or other manipulations or related attempts (including by third parties) is not permitted, nor is any breach of the conditions of participation or any related attempt. In the aforementioned cases or in the event of suspicion to this effect, the Organiser has the right to exclude a participant from the sweepstake and to subsequently rescind or reclaim prizes.

The Organiser shall not be liable for any direct, indirect, special losses and/or damages incurred by the participants as a result of their participation and associated with a malfunction in the communication or power lines, mobile network operator outages, effects of malicious software, unfair acts by third parties aimed at unauthorised access and/or disabling of the Organiser’s software and/or hardware, as well as force majeure conditions. In such cases, the Organiser is not obliged to reimburse any losses incurred by the participants.

Organiser is liable to the participants

• for culpably caused damage resulting from injury to life, limb or health,
• for damage caused wilfully or through gross negligence by the Organiser, the legal representatives or vicarious agents of the Organiser, and
• for damages arising from a breach of a guarantee given to the participant without limitation in accordance with the statutory provisions.

Otherwise, the Organiser shall be liable only for the slightly negligent breach of obligations whose fulfilment is essential for the proper execution of the operation and on the observance of which the participant may regularly rely (cardinal obligations), limited to contractually typical, foreseeable damage. The above limitation of liability applies accordingly to the personal liability of the legal representatives and vicarious agents of the Organiser.

The sweepstake is in no way connected to Instagram and is in no way supported, accompanied or controlled by Instagram. The recipient of the information provided is not Instagram, but Depenbrock Holding SE & Co. All questions, comments or complaints should therefore not be addressed to Instagram, but to Depenbrock Holding SE & Co. Participation does not give rise to any claims against Instagram.

The Organiser, who is responsible for the processing of the data, uses the data provided by the participants (Instagram account, shipping address, surname, first name, e-mail address if applicable) in accordance with the provisions of the applicable data protection law (GDPR, BDSG).
The data will only be used to carry out the sweepstake (Art. 6 (1) b) GDPR).
In addition to the right to withdraw consent given to us, you have the following additional rights if the respective legal requirements are met:

• the right to information about your personal data stored by us in accordance with. Art. 15 GDPR;
• the right to rectification of inaccurate data or to completion of correct data in accordance with. Art. 16 GDPR;
• the right to erasure of your data stored by us in accordance with. Art. 17 GDPR insofar as no statutory or contractual retention periods or other statutory obligations or rights to further storage are to be complied with;
• the right to restrict the processing of your data in accordance with. Art. 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it; the controller no longer needs the data, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR;
• the right to data portability pursuant to Art. 20 GDPR, i.e. the right to receive selected data you have provided to us in a commonly used, machine-readable format or to request that it be transmitted to another agent
• the right to lodge a complaint with a regulatory authority. For this purpose, generally you can contact the regulatory authority of your usual place of residence or workplace or our company headquarters. The regulatory authority responsible for the Organiser is Hamburg.

German law shall apply exclusively to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which the consumer has their habitual residence remain unaffected.

Should individual provisions of these conditions of participation be invalid or contradict the statutory regulations, this shall not affect the remaining conditions. In this case, the statutory regulations apply. The same applies to closing a contractual loophole. Legal recourse is excluded.
